By booking our services, you acknowledge that water activities involve inherent risks. All renters must comply with safety requirements and local maritime laws. Professional captain services are strongly recommended for all yacht charters.
1. Acceptance of Terms
By booking or using any services provided by MiamiA1Boats ("Company", "we", "us"), you ("Renter", "you") agree to be bound by these Terms of Service. These terms constitute a legally binding agreement between you and MiamiA1Boats.
2. Services Offered
MiamiA1Boats provides the following services in Miami, Florida:
- Luxury yacht charter services with professional captains
- Sport boat rentals with captain included
- High-performance jet ski rentals
- Marine equipment and safety gear
- Customized water excursions and tours
3. Booking and Reservations
Reservation Requirements
- All renters must be at least 21 years old and provide valid government-issued photo ID
- A valid credit card is required for booking and security deposit
- Driver's license required for all boat rental services
- Boating experience may be required for certain vessels
Booking Confirmation
Your reservation is confirmed upon receipt of required deposit and completion of rental agreement. Availability is subject to weather conditions, mechanical issues, and other factors beyond our control.
Payment Terms
- 50% deposit required to secure booking
- Full payment due at time of service
- Security deposit required for all rentals (amount varies by vessel)
- Additional charges may apply for damage, cleaning, or fuel
4. Cancellation and Refund Policy
Customer Cancellations
- 48+ hours advance notice: Full refund minus 10% processing fee
- 24-48 hours advance notice: 50% refund
- Less than 24 hours: No refund (exceptions for emergencies)
- No-show: No refund
Weather-Related Cancellations
We prioritize safety and may cancel services due to adverse weather conditions. In such cases, you will receive a full refund or the option to reschedule without penalty.
5. Safety Requirements and Responsibilities
Pre-Rental Safety Briefing
All renters must complete a comprehensive safety briefing covering:
- Vessel operation and safety procedures
- Emergency equipment location and usage
- Local maritime rules and regulations
- Weather and water condition awareness
- Radio communication procedures
Safety Equipment Requirements
- Life jackets must be worn by all passengers under 6 years old
- Life jackets must be available for all passengers at all times
- Fire extinguisher, flares, and first aid kit included with all rentals
- VHF radio for emergency communication
Prohibited Activities
- Operation under the influence of alcohol or drugs
- Reckless or unsafe operation of vessels
- Exceeding vessel capacity limits
- Operating in restricted or dangerous areas
- Swimming in prohibited areas or rough conditions
6. Renter Responsibilities
Vessel Care
- Operate vessel in a safe and responsible manner
- Follow all operating instructions and guidelines
- Report any mechanical issues immediately
- Return vessel in same condition as received
- Secure vessel properly when anchored or docked
Legal Compliance
- Comply with all federal, state, and local maritime laws
- Respect marine life and environmental regulations
- Obtain any required permits or licenses
- Maintain proper vessel registration and documentation
7. Damage and Liability
Damage Responsibility
Renters are responsible for any damage to the vessel, equipment, or third-party property that occurs during the rental period. This includes:
- Hull damage, scratches, or dents
- Engine or mechanical damage due to misuse
- Interior damage or excessive cleaning requirements
- Lost or damaged equipment
Insurance Coverage
All vessels are covered by comprehensive marine insurance. However, renters may be responsible for deductibles and damage not covered by insurance. We strongly recommend renters carry their own boat rental insurance.
8. Limitation of Liability
MiamiA1Boats' liability is limited to the maximum extent permitted by law. We are not liable for:
- Personal injury or death (except due to our gross negligence)
- Property damage or loss
- Weather-related delays or cancellations
- Mechanical breakdowns or equipment failures
- Third-party actions or accidents
9. Indemnification
Renters agree to indemnify and hold harmless MiamiA1Boats, its owners, employees, and agents from any claims, damages, or expenses arising from:
- Renter's use or misuse of rental equipment
- Violation of these terms or applicable laws
- Negligent or intentional acts by renter or passengers
- Third-party claims related to rental activities
10. Age and Capacity Restrictions
Age Requirements
- Primary renter must be 21+ years old
- Jet ski operators must be 18+ years old (or 16+ with parent/guardian)
- Children under 6 must wear life jackets at all times
- Supervision required for all minors
Capacity Limits
Strict adherence to vessel capacity limits is required. Exceeding capacity limits voids insurance coverage and may result in immediate termination of rental.
11. Fuel and Operating Costs
- Fuel costs are included in charter services with captain
- Self-rental boats: fuel costs are renter's responsibility
- Vessels must be returned with same fuel level as departure
- Refueling charges apply if vessel returned with less fuel
12. Environmental Responsibility
All renters must:
- Respect marine sanctuaries and protected areas
- Avoid disturbing wildlife and coral reefs
- Dispose of waste properly (no dumping overboard)
- Use reef-safe sunscreen and products
- Follow all environmental protection guidelines
13. Emergency Procedures
In Case of Emergency
- Contact Coast Guard immediately: VHF Channel 16 or 911
- Contact MiamiA1Boats: (786) 537-5850
- Provide vessel location, nature of emergency, and number of persons aboard
- Follow all Coast Guard instructions
Emergency Equipment
All vessels are equipped with required safety equipment including life jackets, fire extinguisher, flares, VHF radio, and first aid kit. Renters must familiarize themselves with equipment locations and operation.
14. Modifications and Updates
MiamiA1Boats reserves the right to modify these terms at any time. Changes will be posted on our website and take effect immediately. Continued use of our services constitutes acceptance of revised terms.
15. Governing Law
These terms are governed by the laws of the State of Florida and federal maritime law. Any disputes will be resolved in the courts of Miami-Dade County, Florida.
16. Severability
If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
Acknowledgment
By booking our services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. You also acknowledge the inherent risks involved in water activities and agree to participate at your own risk.
